Police Across California Crack Down on Illegal E-Bikes: Here's What You Need to Know

As electric bikes continue to surge in popularity across California, police departments are stepping up enforcement against illegal or non-compliant e-bikes—many of which are being seized on the spot.

Recently, law enforcement agencies across the state have begun impounding high-powered e-bikes that don't meet California's strict safety and classification standards. In one city alone, 12 e-bikes were taken off the road in a single day for exceeding legal speed limits or lacking required features like functional pedals.

“These vehicles may look like e-bikes, but they’re not street legal,” one police department noted in a public statement. “If they don’t meet California’s e-bike classification standards, they’re not permitted on public roads, sidewalks, or bike paths.”

Some of the impounded bikes were clocked at speeds over 40 mph, well beyond what California allows for any of its three official e-bike classes. These types of vehicles—often sold online with few safety warnings—are considered off-highway vehicles, not bicycles, and are illegal to operate on city streets.

What This Means for Riders

The growing enforcement highlights the need for riders to choose e-bikes that are fully compliant with California law. E-bikes must fit into one of the state’s three classes to be used legally on public roads:

  • Class 1: Pedal-assist only, max speed 20 mph

  • Class 2: Throttle-assisted, max speed 20 mph

  • Class 3: Pedal-assist only, max speed 28 mph, helmet required, age 16+

If your bike doesn’t have pedals, goes too fast, or lacks proper safety features, it could be confiscated—and you could be fined.
